I’m 16 years old,
and currently in a custody battle.
My mother, who currently has custody of me,
is verbal & physically abusive,
so I do not want to live with her anymore.
But here’s the twist,
my dad doesn’t live in the same state as I do.
But he’ll be the one getting full custody of me.
Yes, you can live by yourself. I know because I personally did when I was 17 (waaaaay back in 1992. lol) and now my boyfriends 16 year old daughter lives by herself. The interesting thing is she moved out on her own for the same reason you want to. Her mom is abusive and also an alcoholic. You can petition the court to be emancipated (term that means to become a legal adult under the age of 18) if need be. Cite the abuse as a reason if she fights it.
You are two years too young to be by yourself, but not too young to determine your custody arrangements… that is your legal right as of age 14!
Have your dad make the appointment with the family court judge that assigns the custody and child support. The judge will interview you. Just tell the judge that you need to live with your dad because it will be a more stable and supportive living arrangement, and because your mom is abusive and doesn’t want anything but the child support money. You need a safe place to live.
Your mom will be cheesed off for being cut off from the child support money.
After that, if you want to stay in the same town, see if your dad can arrange for you to stay with “safe” family members and sign an agreement authorizing them as your legal guardian to act in his stead… and that agreement should be on file with the court. If you do the court paperwork right, it will all come down to what you and your dad agree to do.
You’ll need to look into emancipation laws for your state.
Here is a website to get you started:
Unfortunately Kentucky doesn’t seem to have any emancipation laws. However the state your father lives in might.
Yeah, in Ohio I have two friends that live in their own apartments away from their parents. My advice would get a lawyer or if you have one, to ask him about these kinds of laws because I’m sure every state has different ones.
WELL IN ORDER TO BE AN IMANSIPATED MINOR YOU HAVE TO GO THREW A JUDGE AND YOU HAVE TO SHOW PROOF THAT YOU ARE FINANCIALLY STABLE… IN EXAMPLE YOU HAVE TO HAVE A STABLE JOB. AND YOU HAVE TO HAVE GOOD REASON FOR BEING CONSIDERED AN ADULT. WHICH YOU DO, BUT THE JUDGE WILL FINDS WAYS FOR YOU TO STAY A MINOR. IT TAKES A LOT OF PAPERWORK AND TIME. LOOK INTO IT IF YOU TRULLY WANT IT GO FOR IT.
as yur mother has no custody rights over yu, and yur dad has FULL custody. if he approves of yu living in your own place its definately allrite. especially since hes gunna pay for everything, is even better.
Oooooh and that sucks that your mom is abusive :L
Best of luck and I hope you live in a great place and stay confident 🙂
yea you can as long as your parents know where you are if the don’t know where you are you could get caught as a runaway and in juvie for a while
you’d have to take it to court.
you have to be able to get a job first off.
